GENERAL PROVISIONS This document (together with all documents referred to herein) establishes the terms and conditions governing the use of this website www.susurriperfumes.com (hereinafter “susurriperfumes.com” / “the Site”) and the placement of product orders through this Site (hereinafter “the Terms”).
Any product or service offered through this Site is intended for natural persons who can purchase/access them for personal use without the purpose of resale, hereinafter referred to as “Customer” / “Customers”. ARCANUM SUSURRI SRL has no obligation or liability resulting from successive resales of products and/or services made by Customers.
Please read the Terms and our Privacy Policy (hereinafter collectively referred to as “Data Protection Policies”) before using the Site and placing orders through it. By accessing and using this Site and/or placing an order through it, you expressly acknowledge the binding nature of the Terms and Data Protection Policies and commit to complying with these Terms and Data Protection Policies.
If you do not fully accept the Terms and Data Protection Policies, do not use this Site. We reserve the right to modify these Terms from time to time without prior notice. The Terms specified on susurriperfumes.com at the time of placing the order will apply to your order.
If you have any questions regarding the Terms or the Data Protection Policies, you can contact us at any time at contact@susurri.ro. The Contract (as defined below) may be concluded if you express your option in this regard.
All timeframes provided herein are to be interpreted as being expressed in calendar days. If the last day of the term is a non-working day, the term is appropriately extended to the next working day.
SITE OPERATOR The operator of the website www.susurriperfumes.com is ARCANUM SUSURRI SRL, a company organized under Romanian law, headquartered in Ghiroda village, Ghiroda commune, 170 Dunărea St., Timiș County, registered with the Trade Register under no. J35/5422/2022.
CUSTOMER DATA The information or personal data provided by the Customer will be processed in accordance with the Data Protection Policies. By using this Site and/or placing a product order through susurriperfumes.com, the Customer expressly and unequivocally expresses their consent regarding the processing of this information and data and declares that all the information and data provided to us are true and accurate and that they have obtained the prior written consent of the information and/or data owner, in the event that the information and data provided through the Site do not belong to them.
USE OF THE SITE By using this Site and/or placing any product order through it, the Customer undertakes:
To use this Site exclusively to submit legitimate inquiries or place legitimate orders.
Not to place any false or fraudulent orders. If we have reasonable grounds to believe that such an order has been placed, we shall have the right to cancel the order and appropriately inform the competent authorities.
To provide a correct and exact e-mail address, postal address, and/or other contact details. Equally, the Customer expresses their consent for us to use this information to contact them in the event this is necessary (see our Privacy Policy).
If we are not provided with all the information we need, we may not be able to complete your order. By placing an order through the Site, the Customer declares that they are over 18 years old and have the full legal capacity to enter into binding contracts.
Customer Account Each Customer has the possibility to create a Customer Account on the susurriperfumes.com platform, thus becoming a susurriperfumes.com member and benefiting from all the advantages of account registration. Please bear in mind that you are solely responsible for maintaining the confidentiality and security of your account. You are also solely responsible for all activities that occur under or in connection with your account and you agree to immediately notify ARCANUM SUSURRI SRL of any unauthorized use of your account or any other breach of security. ARCANUM SUSURRI SRL will not be liable for any damages resulting from the unauthorized use of your account.
In the case of campaigns dedicated to susurriperfumes.com members involving the sending of mini-samples or promotional materials, these will only be sent to Customers residing in Romania.
Fraud Attempts at unauthorized access to the Site, including but not limited to any attempt to access the personal data of another Customer, to modify the content of the susurriperfumes.com site, or to affect the performance of the server on which it runs, will be considered attempts to defraud the susurriperfumes.com site and will be reported to the competent authorities, initiating criminal investigation against those who attempted this act.
Communication Opinions or addresses containing insults or inappropriate language will be excluded from the site or ignored. By using the contact form or the service present on the site, the Customer allows ARCANUM SUSURRI SRL to contact them by any available means, including electronic means. The partial or full completion of the contact form and its submission does not represent in any way a commitment on the part of ARCANUM SUSURRI SRL to contact the Customer.
Cookies The susurriperfumes.com site uses its own cookies and cookies installed by third parties, such as Google, to offer you the best possible experience on the site. THE ORDER To place an order, the Customer must follow the online purchasing procedure, complete the necessary steps: cart, delivery, payment, and click on the “Submit Order” button. Subsequently, the Customer will receive an e-mail from us confirming the receipt of the order (“Order Confirmation”). Please note that this does not mean an order has been accepted, as your order constitutes an offer you make to us regarding the purchase of one or more products from us. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending an e-mail confirming the dispatch of the product (“Dispatch Confirmation”). The fiscal invoice will be included in the package or will be sent via e-mail in electronic format.
By completing the order, the Customer consents that all data provided by them, necessary for the purchasing process, are correct, complete, and true at the date of placing the order.
All product orders are subject to the availability of the respective products in our stock. In the event of supply difficulties or if the products are no longer in stock, we will fully refund any sums of money you have paid, should you not desire replacement products.
ARCANUM SUSURRI SRL reserves the right to refuse the total or partial acceptance of an order in the following cases: a. The products are not in stock; b. Payment is not completed; c. The data provided by the Customer on the Site are incomplete or incorrect; d. The Customer’s activity on the Site may cause damage to ARCANUM SUSURRI SRL and/or its partners; e. There is one or more confirmed and uncollected orders.
Orders placed from Monday to Friday will be processed within 24 – 48 hours of receipt, and orders placed on Saturdays and Sundays will be processed starting the first working day.
CONCLUSION OF THE CONTRACT The information provided in the Terms and the data contained in this Site do not constitute an offer to sell, but an invitation to treat. The contract for the purchase of a product (“the Contract”) is concluded only at the moment the Dispatch Confirmation is transmitted.
PRICE OF PRODUCTS The price of each product will be as quoted on our Site, except in cases of obvious error. The prices displayed include VAT but exclude delivery costs. Prices are subject to change at any time without prior notice, but no potential change will affect orders that have already been confirmed.
PAYMENT FOR PRODUCTS Payment options vary depending on the delivery country. For Romania, the available options are: a. Cash on Delivery (by Courier) b. Online Payment (via Netopia payment processor, under secure SSL and 3D Secure conditions).
DELIVERY Estimated delivery time: 3-5 working days. For the purposes of these Terms, “delivery” is deemed to have occurred when you or a third party designated by you acquires physical possession of the products.
If, for objective reasons, we cannot meet the delivery date, we will inform you of this situation. We do not deliver on Sundays. If packages show signs of damage (torn package, opened, etc.), we recommend that you refuse the collection of the package and notify us at contact@susurri.ro.
Delivery methods for Romania: Courier, Locker Delivery, Romanian Post. International delivery methods: Courier.
TRANSFER OF RISK AND OWNERSHIP All risks related to the products will pass to the Customer upon delivery. Ownership of the products will only pass to the Customer when we receive full payment of all sums due.
RETURN POLICY Right of withdrawal: The Customer has the right to withdraw from the contract, without specifying any reason, within 14 calendar days, according to GEO no. 34/2014. To exercise this right, the Customer must notify ARCANUM SUSURRI SRL by e-mail at contact@susurri.ro or at the headquarters in Ghiroda village, Ghiroda commune, 170 Dunărea St., Timiș County.
Effects of withdrawal and Exceptions: The Customer must return the products in the same condition in which they were delivered (in undamaged original packaging), bearing the return costs. We will refund the value of the product within a maximum of 14 days from the notification of withdrawal.
Important Notice: According to the provisions of Art. 16 lit. e) of GEO no. 34/2014, sealed products that cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer are exempt from the right of withdrawal. Therefore, perfumes and cosmetic products whose original individual packaging has been opened, unsealed, tested, or used cannot be returned to ARCANUM SUSURRI SRL and cannot be subject to the right of withdrawal.
COMPLAINTS MANAGEMENT. WARRANTY The conditions for the legal guarantee of conformity are in accordance with the provisions of GEO no. 140/2021 on certain aspects concerning contracts for the sale of goods and GO no. 21/1992 on consumer protection. In case of lack of conformity, it is necessary to present the non-compliant product, together with proof of its purchase.
INTELLECTUAL PROPERTY AND COPYRIGHT All the content of the www.susurriperfumes.com site is the exclusive property of ARCANUM SUSURRI SRL and is protected by copyright. Any reproduction or representation, in whole or in part, of the site for other purposes, particularly commercial ones, is expressly prohibited without prior written consent.
ASSIGNMENT AND SUBCONTRACTING The Customer may not transfer a Contract without previously obtaining the written consent of ARCANUM SUSURRI SRL. ARCANUM SUSURRI SRL may transfer, assign, and/or subcontract a Contract at any time, without this affecting the legal rights of the Customer as a consumer.
NOTIFICATIONS ARCANUM SUSURRI SRL may send notifications regarding the company’s activity to the e-mail address provided in the subscription form. Opting out of receiving notifications can be done using the specific link within the newsletters or by contacting us directly. ARCANUM SUSURRI SRL will not include in the notifications sent to the Customer any advertising material referring to any third party that is not a partner of ARCANUM SUSURRI SRL.
DISPUTES Any relationship established by the purchase of products or services through the Site is governed by Romanian law. Any conflict between ARCANUM SUSURRI SRL and another party is subject to an amicable settlement. If no agreement is reached, the jurisdiction lies with the competent courts in Timișoara. For the alternative resolution of disputes, consumers have at their disposal the European Online Dispute Resolution (ODR) platform, which can be accessed at http://ec.europa.eu/consumers/odr/, as well as the procedures provided by the National Authority for Consumer Protection (www.anpc.ro).
TERMINATION ARCANUM SUSURRI SRL reserves the right to terminate the activity of the Site without prior notice.
OTHER CLAUSES These Terms constitute the entire agreement between the Customer and ARCANUM SUSURRI SRL. We reserve the right to make any changes to these provisions without prior notice to the Customer.
